The thesis aims to examine the duty to provide information from both a legal economic perspective and a legal sociological perspective. From a legal economic perspective, the duty to provide information is discussed as a way of evening out information asymmetries and as a way for potential franchisees to compare the terms and conditions of one franchisor with those of another.
What conditions must be in place for the duty to provide information to be effective? And how does the Swedish Franchise Act (2006:484) on the franchisor's duty to provide information meet the criteria set? The legal sociological perspective discusses, among other things, how a franchisee should invoke their right to accurate information and the provision of information as a pre-contractual duty of loyalty, but also the difference between pre-contractual and contractual disclosure obligations.
